THE E! PEOPLE'S CHOICE AWARDS – 2020 OFFICIAL VOTING RULES

 

The following terms (the "Official Voting Rules") govern voting available during certain periods relating to the 2020 The E! People's Choice Awards (the "Show"). Please note that the Official Voting Rules are subject to change at any time at the sole discretion of NBCUniversal Media, LLC, or E! Entertainment Television, LLC (collectively, "NBCU") and/or Telescope Inc. ("Administrator" and, together with NBCU, the "PCA Entities"). The following chart summarizes the Voting Windows (and Periods), Methods, and Limits, each of which are described in more detail in these Official Voting Rules:

*Unless otherwise noted, all dates are in 2020, and the times are from 10:00 am ET (or such other time to be announced by NBCU) on the first date indicated through 11:59 pm ET on the second date indicated.

**Each limit is per person, per Voting Method, per category, per day, except for X-Finity voting, which is (25) times per ballot, per Xfinity device, per candidate, for the duration of the Official Voting Window.

Except for Xfinity Voting (as defined below), the voting methods are open to voters worldwide for forty-three (43) categories.  In addition, voters located in the following areas and countries will have the opportunity to vote in one (1) additional category, which shall be open only to voters in those areas via geotargeting and direct deep-linked URL:

Employees of Telescope Inc. or its affiliated companies and members of their immediate families (spouses, partners, children, siblings and parents) are ineligible to vote. NBCU may select winner(s) of additional honorific awards in certain additional regions or categories, and such award categories will not be eligible for voting.  For help with any Voting Method, send an email to info@telescope.tv.

 

1. Voting Methods, Availability and Limits

During the Voting Windows (defined below), fans may submit votes via the below voting methods. There are three (3) Voting Methods available to fans, but some methods may be available for limited Voting Windows or for limited categories as set forth in these Official Voting Rules:

  1. Online Voting
  2. Twitter Voting
  3. Xfinity Voting

The Online Voting, Twitter Voting and the Xfinity Voting, are referred to herein, collectively, as the "Voting Methods." See Section 3 below for information on costs associated with voting.

1.1 Online Voting

Fans may also vote by using pca.eonline.com ("Online Voting"). Fans may access Online Voting two (2) ways – by directly visiting the Online Voting site at pca.eonline.com or via the E!  or E! News App ("App(s)").

To access Online Voting via the App(s), download the E! or E! News App from the App Store or Google Play. Open E! or E! News App and navigate to the "Vote Now" graphic.   The link will open up a mobile site version of the Online Voting site.  Follow the directions below once you have reached the Online Voting site.  

To access the Online Voting site directly, visit pca.eonline.com or click on the banner featured on the eonline.com voting call-to-action.

Once you have reached the Online Voting Site, register by providing your Facebook login credentials or e-mail address, and confirming your acceptance of the Official Voting Rules, and website Terms of Service and Privacy Policy.

During the Fan Favorite Window, fans have the ability to type in a nominee name for any category and click on the "Submit" button at the side of the text box to "write in" a vote for their favorite to nominate in any category.  During the Official Voting Window, once you are logged in to Online Voting, you may vote by clicking on the selection of your choice. Once you click on your selection, you will have the ability to place up to twenty-five (25) votes for that selection.  For each applicable Voting Window, Online Voting is limited to twenty-five (25) votes per category, per day, per e-mail address or Facebook account. Votes must be cast by the authorized account holder of the email or Facebook account from which votes are made. Information collected from you via Online Voting is subject to the NBC Universal Privacy Policy (located at www.nbcuniversal.com/privacy).

1.2 Twitter Voting During the Official Voting Window

Fans may vote via Twitter hashtag ("Twitter Voting"). To vote via Twitter, you must have a valid Twitter account (visit Twitter.com to register for an account) and have your account privacy setting set to public. Twitter votes must be initiated by the authorized Twitter account holder. Twitter votes will only be recognized from Twitter accounts which are public, incorporate an avatar image or profile picture, have more than 10 followers and were created at least 24 hours prior to the time of the applicable vote post.  To vote during the Voting Windows, post or retweet a public Twitter message (i.e., a tweet) containing one (1) designated category hashtag (e.g., #themovieof2020) and one (1) designated nominee hashtag. If more than one (1) designated nominee hashtag is contained in a tweet, none of those votes will count.  Alternatively, fans can vote via Twitter by clicking on the Twitter logo beneath "Share your vote" on the "Thank You For Voting" pop-up window after voting via Online Voting. For each applicable Voting Window, Twitter Voting is limited to twenty-five (25) votes per category, per day, per Twitter account. Retweets made during each Voting Window will be accepted as vote(s) from the Twitter ID that retweets (subject to the limitations below).   Misspellings will not be counted; however, each nominee has one (1) hashtag and two (2) acceptable alternate spelling variations. Fans may find the designated nominee hashtags on the FAQ page located at https://www.eonline.com/peoples_choice_awards/faq.  Nominee hashtags are not case-sensitive. Twitter Votes are also subject to Twitter's Terms of Service, including a prohibition on containing subject matter that does not comply with Twitter's Terms of Service (e.g., obscene, violent, or threatening content). Tweets that violate Twitter's Terms of Service may be taken down and such vote may not count. Information collected from you via Twitter Voting is subject to the NBCU Privacy Policy (located at www.nbcuniversal.com/privacy). Twitter Votes may not contain any derogatory references to NBCU, the Show, sponsors of the Show or nominees.  You agree that any content that you submit in connection with a vote on Twitter may be used by the PCA Entities in connection with the advertising, promotion, production, or exhibition of the Show.

1.3 Xfinity Voting

Fans may vote by using their X1 set-top box ("Xfinity Voting") for four (4) categories: The Movie of 2020, The Song of 2020, The Show of 2020, and The Comedy Act of 2020.

To vote via the X1 set-top box, you must have an X1-enabled set-top box, X1-enabled remote and an active Xfinity TV subscription that includes E! (fees may apply). You can access the X1 voting screen on your television during the applicable Voting Window(s). First, you may use your X1-enabled remote and press the "Info" button when prompted on the screen (you will see a graphic in the top right corner of the screen that indicates that voting is open and that directs you to press the info button [the "X1 Vote Graphic"]). If you do not see the X1 Vote Graphic, use your X1-enabled remote to search for The E! People's Choice Awards and pull up the Show page. On the Show page, you will see a bar on the bottom of the screen with various options, such as options for series information and recording episodes. Use your X1-enabled remote to select the "Vote" option.

Once you have arrived at the X1 voting screen, use your X1-enabled remote to make your selection and confirm your vote. Once you have clicked the "Confirm" button, your vote will be submitted and counted as valid (subject to the limitations below) and you will be directed to a "Thanks for voting" screen. You can also navigate these steps using voice commands by saying "Vote for the People's Choice Awards" into their Xfinity Voice Remote. Subject to the limitations below, eligible persons may vote twenty-five (25) times per ballot, per Xfinity device, per candidate, for the duration of the Official Voting Window. Votes may be cast only by the authorized account holder of the Xfinity account from which votes are made.

Information collected from Xfinity Voting via the X1-enabled set-top box is subject to the Comcast Customer Privacy Notice (located at http://www.xfinity.com/Corporate/Customers/Policies/CustomerPrivacy).

1.4 Voting Method Limits

Any vote attempts above the limits set forth above will not be counted as valid. NBCU reserves the right to change the above-mentioned limits on the number of votes that may be made via each Voting Method in NBCU's sole discretion. The PCA Entities reserve the right, in their sole discretion, to reject votes cast by any individual who does not abide by the Official Voting Rules or who tampers with the voting process or acts in a disruptive or unsportsmanlike manner or to take any other actions that they deem appropriate (including without limitation removing such Voting Method from the Show altogether). Please note that certain Voting Method limits and restrictions may not be enforceable as written due to limitations on the Administrators' ability to prevent and track certain Voting Method misuses, such as limitations on the ability to duplicate votes submitted by one user via multiple accounts or by more methods than allowable under the Official Voting Rules.

1.5 Turbo Voting

From 12:00 am ET – 11:59:59pm ET on October 15th, (or such other dates as NBCU may determine in its sole discretion, but which shall be announced on eonline.com and/or pca.eonline.com (each a "Turbo Voting Period"), "turbo voting" shall be applied to all votes. This means that any time you vote during any Turbo Voting Period, via any of the Voting Methods, each of your votes will count as two votes. Accordingly, and notwithstanding the above-mentioned voting limits, the limit for each Voting Method shall be 50 votes per category, per day, per e-mail address or applicable social media account for the duration of the Turbo Voting Period except for X-Finity voting, which will be 50 votes per ballot, per Xfinity device, per candidate, per candidate.

 

2. Voting Windows

Voting by any Voting Method may be available during multiple voting windows ("Voting Window(s)"), as specified in these rules. Additional Voting Windows may be added and the below Voting Windows may be changed as determined and announced by NBCU in its sole discretion.

2.1 Fan Favorite Window

For all geographic regions, commencing at 10:00 am ET on September 14, 2020, through 11:59 p.m. ET on September 18, 2020 (the "Fan Favorite Window"), fans can write-in their favorite suggested nominees using the Online Voting Method described above.  The total number of valid votes for each nominee within the Fan Favorite Window will be added to other data compiled by NBCU to inform NBCU's decision as to who will become the nominees eligible for selection as a potential winner during the Official Voting Window.

2.2 Official Voting Window

For all geographic regions, commencing at a time selected by NBCU on October 1, 2020, through 11:59 p.m. ET on October 23, 2020 (the "Official Voting Window"), each category will have eight (8) nominees.  Fans can vote using the Voting Methods.  The total number of valid votes within the Official Voting Window from the Voting Methods will be added together to determine which finalist will become the potential winner.

 

3. Cost of Voting

3.1 Voting Methods

Each of the Voting Methods is subject to standard Internet access charges and data rates may apply, including, as applicable, app download and usage charges.

3.2 Xfinity Voting

Viewers voting using the X1-enabled set-top box must have an X1-enabled set-top box, X1-enabled remote, and an active Xfinity TV subscription that includes E! (fees may apply). Review the Xfinity Customer Agreements, Policies & Service Disclosures for more information.

 

4. Selection of Winners

The nominee who receives the highest number of valid votes in each category, as determined by Administrator and as described above, will be deemed the potential winner of the category; provided that in the event of technical or reporting difficulties with the Voting Methods, or in the event two or more nominees receive the same number of votes such that the finalists and/or winner(s) cannot be determined, or for any other reason NBCU deems appropriate, NBCU reserves the right to make the final determination as to which of the nominees will be declared the winner of the category.  In the event that two or more nominees receive the same number of votes, the nominee that received the largest number of votes via the Online Voting Method will be deemed the winner. Administrator reserves the right to have winners be determined by any method determined by NBCU in its sole discretion, and NBCU reserves the right to disqualify any finalist or potential winner if, at any time before or during the Show, such finalist or potential winner is subject to adverse publicity relating to such finalist's or potential winner's involvement in any act which is illegal, or insults or offends community moral standards or public decency, in NBCU's sole discretion. 

 

5. Disclaimers

NBCU, Comcast, Telescope, Inc., and each of their respective direct or indirect parents, subsidiaries, related and affiliated entities and persons, and each of their respective agents, officers, directors, employees,  managers, members, contractors, and their respective successors, licensees and assigns, and any other entity involved in the development, administration, promotion, or implementation of any Voting Method and these Official Voting Rules (collectively, the "Released Parties") are not responsible for and shall not be liable for: difficulties, failures or malfunctions of computers, phones (including wireless phones/handsets) tablets and/or other devices, phone lines or telephone systems or other communications malfunctions; cellular equipment towers, telephone systems or wireless services; interrupted or unavailable networks, applications or servers; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission, communication or report; traffic congestion or for any technical or other problem which may cause the voting to be disrupted or corrupted.

If for any reason the voting is not capable of being executed as planned, or if there is an infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical or reporting failures, or if any other causes beyond the control of the PCA Entities s corrupt or affect the administration, security, fairness, integrity, or proper conduct of this voting, the PCA Entities reserve the right, in their sole discretion, to take any action they deem appropriate or to withdraw the transmission of any vote, but are in no way obligated to do so. Furthermore, the PCA Entities may, but are not obligated to, permanently disqualify from any voting any person PCA Entities believe has intentionally violated these Official Voting Rules, and terminate or suspend voting at any point and declare the vote results based on the votes up to that point, if it appears that the voting process has been so distorted by hacking, failures, errors or other interference that the results would not reflect actual valid votes should the voting continue.  In the event of technical or reporting difficulties with any of the Voting Methods, including, but not limited to, mobile or Internet service interruptions, PCA Entities, in their sole discretion, reserve the right to review the votes for accuracy and to take any action they deem appropriate, including, without limitation, voiding all votes cast during the time period in which such technical or reporting difficulties occurred, voiding the votes cast during the time period in which such technical or reporting difficulties occurred with such method, and/or removing such method of voting from the Show altogether and relying only on the other voting methods, but are in no way obligated to do so.  The Released Parties assume no responsibility for any injury or damage to participants or voters or to any person's computer or other property relating to or resulting from entering or downloading materials, applications or software in connection with this vote, or otherwise participating in this voting. The Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription or reporting of voting information, errors in any promotional or marketing materials, for any human or electronic error, or for votes or reports that are stolen, misdirected, garbled, delayed by computer transmissions, lost, or late.  By participating, each individual agrees to release and hold the Released Parties harmless against any and all claims and liabilities of any kind arising in whole or in part, directly or indirectly, out of such individual's participation in the voting. The PCA Entities will take commercially reasonable steps where practicable to prevent voting outside of the applicable geographic area, if any; however, some votes cast outside of the applicable geographic area, if any, may be counted. The PCA Entities will also take commercially reasonable steps where practicable to enforce other Voting Method limits and restrictions set forth in the Official Voting Rules.

These rules are subject to change at any time at the sole discretion of the PCA Entities. Notification regarding any such change will be posted at pca.eonline.com.

Caution: Any attempt by a voter or any other individual to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the voting is a violation of criminal and civil laws and should such an attempt be made, the PCA Entities reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

 

6. Conditions for Voting

By voting, you are agreeing to be bound by these Official Voting Rules, and not to use any unofficial, third party services to cast votes on your or any third party's behalf.  The PCA Entities reserve the right, but are not obligated, to disqualify, block or remove any votes from any individual who votes by any electronic, mechanical or automated means, or otherwise tampers with the vote process, or for any other reason, as determined by the PCA Entities in their sole discretion. Any nominee or finalists who offers benefits, compensation, or otherwise tries to give an incentive to voters to manipulate the results of voting may be disqualified and any votes earned by such means may be voided in the PCA Entities' discretion. 

The PCA Entities are not responsible for any damages to voters' device(s) that may occur from voting.  The PCA Entities reserve the right, for any reason and in their sole discretion without any obligation, to modify, suspend or discontinue the voting without prior notice.  The PCA Entities reserve the right to modify the terms and conditions of this voting process at any time in their sole discretion. 

 

7. Dispute Resolution

THESE RULES, AND SUBMISSION OF YOUR VOTE, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF ("JAMS RULES").  THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK.  ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

Except where prohibited, voters agree that (a) any and all disputes, claims, and causes of action arising out of or connected with these Official Voting Rules or the Show, including, but not limited to, the determination of the nominees, finalists, or winners, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with voting, not to exceed $50, but in no event including attorneys' fees.

 

8. Waiver and Severability

The PCA Entities' failure to enforce any term of these Official Voting Rules shall not constitute a waiver of that provision. Should any provision in these Official Voting Rules be deemed void, invalid, illegal, unenforceable or inoperative, such invalid, illegal, unenforceable or inoperative section or provision shall not affect any other section or provision hereof, and the remainder of these Official Voting Rules shall be effective as though such void, invalid, illegal, unenforceable or inoperative section or provision had not been contained herein.
